What is the time frame for the trademark registration in China?

China's trademark system follows the first-to-file principle. At the filing stage, the applicant does not need to provide evidence to prove its actual use or intention to use the applied-for mark, unless requested in limited circumstances.

So you don't need to wait for the trademark being used for certain amount of time.

Obtaining official receipt: around 15-30 days;

Obtaining the notification of publication: around 9 months;

Obtaining the notification of registration: around 12 months;

Obtaining the hard copy of the registration certificate: around 14 months.

Once the trademark is registered in China, it is valid for 10 years.
What type of trademark are prohibited from registration in China?

The following marks are prohibited from registration:

Marks that are against the moral standards or public order of China;

Generic words or terms;

Symbol, flag, or name of a state, nation, region, or an international organization;

Marks that lack distinctive qualities;

Marks that are used primarily to indicate a geographical location name;

Marks that may mislead consumers.
What are the types of trademark that can be registered in China?

The following marks or signs are accepted for registration:

Words；Names；Devices；Certain 3-dimensional shapes；Slogans；

Colours；Sounds；Get-up or trade dress；Combination of all of the above elements；

Collective marks；Service marks；Certification marks；Well-known marks.
What are the phases of application after a trademark has been filed in China?

After the application is submitted, usually it will go through three phrases:

Phrase 1: Formality examination

Official filing receipt will be issued if the formality requirements are complied with.

Phrase 2: Substantive examination

If a favorable decision is issued, the CNIPA will arrange for publication of the trademark application.

Phrase 3: Publication period

Oppisitions can be filed within three-month publication period.

The Registration Certificate will be issued one or two months opon expiry of opposition period.
Can you register a trademark in China by yourself?

No.
